Terms of sale

These terms apply to everything you buy from this website. By placing an order you accept them.

1. Who you are buying from

Calmyo is a trading name of BHL GROUP LLC, a limited liability company registered in New Mexico, United States (entity ID 0008081734, EIN 38-4385956), at 1209 Mountain Rd Pl NE, Ste N, Albuquerque, NM 87110, United States.

We are not an Australian-registered business, we do not hold an ABN, and we are not registered for GST. Your rights under the Australian Consumer Law apply to everything we sell to consumers in Australia regardless.

2. Prices

All prices are in Australian dollars and are the total you pay. No GST is charged, because our sales into Australia are below the A$75,000 registration threshold set by the Australian Taxation Office. Shipping is free. Nothing further is payable on delivery.

3. Orders

Your order is an offer to buy. The contract forms when we send you a dispatch confirmation, not when you pay. Until then we may decline an order — for example if an item is out of stock, if we cannot ship to your address, or if a price has been listed in error. If we decline, you are refunded in full.

4. Payment

Payment is taken at checkout through our payment providers. We never see or store your card details.

5. Delivery

Delivery terms are set out in our Shipping policy, which forms part of these terms.

6. Your rights if something is wrong

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. What these products are

Calmyo products are comfort and wellbeing items. They are not therapeutic goods and not medical devices, they are not entered on the Australian Register of Therapeutic Goods, and nothing on this site should be read as a claim to treat, prevent or relieve any medical condition.

If you have a health condition affecting your legs or back, or you have been advised to use a specific compression class, speak to your doctor or pharmacist before buying. Follow the care and sizing guidance on each product page.

8. Product information

We describe our products as accurately as we can. Photographs are illustrative and colours may vary slightly with your screen. Measurements are approximate and given to the nearest sensible unit. Where we discover an error in a description or price, we will correct it and tell you before dispatch.

9. Our content

The text, photographs, graphics and layout of this website belong to us or are used with permission. You may not copy or reuse them commercially without our written agreement. "Calmyo" is our trading name.

10. Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law. Beyond those rights, and to the extent the law allows, our liability for any claim relating to a product is limited to the amount you paid for it.

11. Governing law

These terms are governed by the law of New South Wales, Australia, and you may bring proceedings in the Australian courts. This does not remove any protection you have under the Australian Consumer Law, which applies to our supplies to Australian consumers in any event.

12. Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
